(“Oway USA,” “we,” “us,” or “our”) — a subsidiary of Rolland S.r.l., an Italian-based company (“Rolland,” our “parent company”) — collects, uses, shares, and protects personal information (“Personal Information”) obtained through this website (the “Site”) and in connection with related services, communications, events, or offline activities.
We value your privacy and are committed to protecting your Personal Information. We will not sell your Personal Information and will only share it as described in this Policy, consistent with applicable law and your consent. We will not share your Personal Information with third parties except as described in this Policy without your consent.
BY USING THIS SITE, YOU AGREE TO BE BOUND BY THIS POLICY. IF YOU DO NOT AGREE WITH ANY OF THE TERMS OF THE POLICY, PLEASE DO NOT USE THIS WEBSITE OR PROVIDE US WITH YOUR PERSONAL INFORMATION.
We may update this Policy periodically by posting a revised version on our Site and indicating the effective date above. If we make material changes to your rights under this Policy, we will notify you by email or through a prominent notice on the Site.

4. How We Use Personal Information
We do not process your Personal Information for targeted advertising or for profiling in furtherance of decisions that produce legal or similarly significant effects.
We use your Personal Information to:
A. Provide Products & Services and Communicate With You
- Provide you with our products and services;
- Process orders and manage your account;
- Register you for events and contests;
- Respond to your requests, questions, comments, and feedback; and
- Deliver customer support and administrative communications.
B. Improve Our Site and Services
- Provide, maintain, and improve the Site;
- Perform website analytics and database management services; and
- Conduct reporting, analytics, and internal administrative activities for Oway USA and Rolland S.r.l. (parent company).
C. Marketing & Promotions
- Send newsletters, promotions, or other marketing communications (you may opt out at any time—see Sections 8 and 10).
D. Create and Maintain Your Account
To utilize certain services provided through the Site, you may be required to create an account using Personal Information (e.g., name, email address, phone number). You have choices about what you include; additional profile information is optional but may help you get more from our services.
E. Compliance, Fraud Prevention & Safety
We may use some or all of your Personal Information as we believe appropriate to:
(a) investigate or prevent violations of the law or your agreements with us;
(b) protect our, your, or others’ rights, privacy, safety, or property (including by prosecuting and defending legal claims);
(c) protect, investigate, and deter against fraudulent, harmful, unauthorized, unethical, or illegal activity;
(d) comply with applicable laws, lawful requests, and legal process (e.g., subpoenas or requests from government authorities); and
(e) where permitted by law in connection with a legal investigation.
For example, we may share information with law enforcement to reduce the risk of fraud or if someone uses or attempts to use our Site for illegal reasons.

5. Consequences of Not Providing Information
You are not required to provide all Personal Information to use our Site or interact with us offline, but certain functionality will not be available if you do not provide Personal Information. We do not sell your Personal Information; however, we may share your Personal Information with third parties for the reasons described below. For example, we may use third parties to design and operate the Site, provide services to support the Site, analyze data, process payments, or send information on our behalf. Unless otherwise indicated at the time we collect your information, if we allow third parties to access Personal Information, we will have contractual provisions or other appropriate protections in place to ensure such access is for limited purposes and in compliance with this Policy.
We share Personal Information as follows:
- Affiliates, Related Organizations & Parent Company: We may share all of the Personal Information we collect about you with our affiliates, related organizations, and Rolland S.r.l. for use consistent with this Policy (e.g., administrative, analytical, and compliance purposes), subject to appropriate cross-border safeguards.
- Service Providers & Business Partners: We may share Personal Information with third parties as needed for them to provide services that help with our business activities and to promote our products and services to you, such as iBeAuthentic, Signifly, or other technical or business support providers, such as Shopify. This may include contact information, payment information, order information, and cookie information. We may also share order information with business partners who offer a service to you jointly with us (where applicable). These parties are contractually bound to use data solely for authorized purposes.
- Compliance, Fraud Prevention & Safety: We may disclose some or all of the Personal Information we have collected about you to government or law enforcement officials or private parties for the purposes described in Section 4(E).
- Business Transfers: We may sell, transfer, or otherwise share some or all of our business or assets — including all of the Personal Information we have collected about you — in connection with a business deal (or potential deal) such as a merger, consolidation, acquisition, reorganization, or sale of assets, or in the event of bankruptcy.
7. Retention of Personal Information
We retain Personal Information only as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements, to resolve disputes, and to enforce our agreements. To determine appropriate retention periods, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it and whether those purposes can be achieved through other means, and the applicable legal requirements.
When data is no longer required, we delete or de-identify it. If permanent deletion isn’t immediately possible (e.g., because data is stored in electronic backups), we will ensure that it is: (a) not used in connection with any decision involving you; (b) not shared except where legally required; (c) kept secure; and (d) permanently deleted once possible.
Marketing Suppression: We generally retain the Personal Information described in this Policy for marketing purposes for as long as you have not opted out. If you ask us not to use your Personal Information for marketing, we may retain certain details in a suppression list to ensure we do not accidentally send you marketing material. We retain customer/order information for as long as we have a legitimate reason (e.g., legal reporting obligations, payment disputes, or to service your account).
8. Your Rights and Choices
Depending on your state of residence, you may have the right to:
- Access / Know: Confirm whether we process your Personal Information, the third parties with which we share Personal Information, and, under certain circumstances, receive a copy (subject to lawful exceptions for sensitive data).
- Correct: Request correction of inaccurate Personal Information we maintain about you.
- Delete: Request deletion of certain Personal Information (subject to exceptions).
- Data Portability: Receive your data in a portable format (where required).
- Opt Out: Direct us not to sell or share your Personal Information for cross-context behavioral advertising (we do not sell; see Section 16).
- Non-Discrimination: Exercise rights without discriminatory treatment.
Making a Request: Only you or an authorized agent may make a request related to your Personal Information. Submit requests by emailing support@owayusa.com or writing to the address in Section 19. Please specify which right you are exercising and provide sufficient information to verify your identity (and your agent’s authority, if applicable).
Responding to Your Request: We will use the information you provide to authenticate your identity or your agent’s authority. We may ask for additional information if we cannot authenticate or if we believe a request is fraudulent. We will try to respond within 45 days and notify you whether your request has been granted or declined or if an exception applies. If we need additional time, we will contact you with the reason and extension period. We will deliver our response electronically unless you direct otherwise. Our response will explain the reasons we cannot comply with any request, if applicable. We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded; if a fee applies, we will provide a cost estimate before completing your request.
Appeal Rights: You have the right to appeal our refusal to take action on a rights request after receiving our decision (use the contact methods above). If you are a Nebraska resident, you also have the right to appeal this refusal to the office of the Attorney General. We will try to inform you of our appeal decision in writing within 45 days after receipt of your appeal. If we need more time, we will contact you with the reason and the extension period. If your appeal is denied or if you have concerns about the results of an appeal, you may contact your state’s attorney general. We will provide their contact information with our appeal response.
9. Verifying, Changing, and Deleting Your Information
If you have an account, you can access, review, and manage many changes yourself via the account portal, including updating your profile information and changing communication preferences. If the information you seek is not available within your account, contact us as detailed below and ask us to change, update, fix, or delete your information in certain cases (particularly if inaccurate). You can also object to, limit, or restrict our processing (if we have no legal right or legitimate business interest in retaining such information), subject to legal retention limits.

- SMS: Text STOP to opt out (text HELP for assistance). Standard message/data rates may apply.

The security of your Personal Information is important to us. We take a number of organizational, technical, and physical measures designed to protect the Personal Information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the absolute security of your Personal Information.
14. International Data Transfers
Oway USA operates in the United States and may transfer Personal Information to Rolland S.r.l. (Italy) or other affiliates and service providers in other countries for legitimate business purposes. Privacy laws in those locations may not be as protective as the laws in your home country; however, we will handle your Personal Information in accordance with this Policy regardless of where it is kept. For EEA/UK/Switzerland → U.S. transfers, we rely on derogations or other lawful mechanisms. Where required by law, you may request a copy of the suitable mechanisms by contacting us.
If you reside in non-US jurisdictions, your use of the Site or provision of any Personal Information constitutes your consent for the transfer of such data to the United States for the purposes identified in this Policy. If you have questions about cross-border transfers, please contact us (Section 19).
15. Children’s Privacy
The Site is not intended for use by anyone under the age of 16, nor do we knowingly collect or solicit Personal Information from anyone under 16. If you are under 16, you should not attempt to use the Site or send any information about yourself to us. If we learn we have collected information from someone under 16, we will delete it promptly.
We have no actual knowledge that we sell or share Personal Information of consumers under 16 years of age.
16. Notice to California Residents (CCPA/CPRA)
This section applies in addition to the rest of this Policy.
A. California Minors Who Are Registered Users
If you are under 18, reside in California, and are a registered user of the Site, you have the right to request that we remove content or information you posted. Email support@owayusa.com with “California Minors Content Removal” in the subject line. Our removal may not ensure complete or comprehensive removal.
B. Personal Information We Collect — Categories, Purposes, Sources (Past 12 Months)
Identifiers (such as name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, or similar):
- Business purpose: To provide you with our products, service your account, for marketing purposes, and to respond to your requests.
- Sources: Directly from you when you provide it to us. We also collect unique personal identifiers such as your IP address passively from you when you visit our Site.
Consumer records (including name, signature, address, telephone number, credit card number, debit card number, or other financial information):
- Business purpose: To provide you with our products, service your account, and for marketing purposes.
- Sources: Directly from you when you provide it to us, and from our third-party service providers.

We will not collect additional categories of Personal Information or use/retain Personal Information for materially different, unrelated, or incompatible purposes without providing notice.
Retaining Your Information (California context)
Retention varies based on purpose. Where Personal Information is used for more than one purpose, we retain it for the longer of those periods.
- We generally retain Personal Information for marketing unless you opt out; if you do, we maintain suppression details to prevent future marketing.
- We retain customer/order information as long as we have a legitimate reason (e.g., legal reporting, payment disputes, servicing your account).
- When no longer required, we delete or de-identify; if data remains in backups, we restrict its use and delete when possible.
Sharing Your Information
We do not share Personal Information with third parties for cross-context behavioral advertising and do not sell Personal Information. In the past 12 months, we have disclosed name, address, and payment information to service providers who help us operate the Site and fulfill orders.
C. Your California Rights
California residents have certain rights (see Section 8). Under California’s “Shine the Light” law, you also have the right to ask us once a year if we have shared your Personal Information with third parties for their direct marketing purposes. To exercise rights, submit a request as detailed above.
D. Notice of Financial Incentives
We may offer loyalty/rewards programs that provide perks such as rewards, discounts, exclusive offers/sweepstakes, contests, or similar promotions (collectively, “Programs”). When you sign up, we typically request name and contact information (e.g., email or telephone number). Each Program may be considered a financial incentive under California law. You can opt in by providing your information and may withdraw at any time via any communication sent after your opt-in. The value to us of your Personal Information collected in connection with a Program relates to the value of the free or discounted products/services or other benefits you obtain, less our expense to offer those benefits.
17. Notice to Nevada Residents
Nevada law allows consumers to request that a company not sell their Personal Information for monetary consideration to certain other parties. We do not sell Personal Information for monetary consideration; however, this right still applies. To exercise this right, email support@owayusa.com (see Section 19).
18. Changes to This Policy
We reserve the right to modify this Policy at any time. If we make changes, we will post them on the Site and indicate the effective date. If we make material changes to your rights, we will notify you by email or through the Site.
